One Nation risks deregistration in Queensland following the failure of Pauline Hanson to advise the Electoral Commission of Queensland about a botched incorporation that has left it with a noncompliant constitution. The party secretly switched legal structures last November without telling members, using a draconian clause in its superseded governance rules that allowed One Nation state executive members to do whatever they chose without question. Former insiders have said a principal purpose for the incorporation was to put in place a corporate veil so the entity rather than members of the executive would be the subject of legal action.

The method of incorporation and the failure to consult is consistent with a trend of centralising all of One Nation’s power in Queensland, which has in the past been illustrated by attempts to close branches across the country through the use of proxies to forcibly remove “troublesome” state leaders, attempts to close bank accounts over which the One Nation national committee had no authority, and the initiation of complaints to police to intimidate a sub-branch in the Northern Territory.

At the same time, the party neglected to observe mandatory rules contained in Commonwealth and Queensland electoral laws, which must be included in its constitution for One Nation to be a political party with legal standing. Breaches of provisions that specify which clauses must appear for a constitution to be compliant under law are grounds for the cancellation of a party’s registration under Section 78 of Queensland’s Electoral Act.

Neither Senator Hanson nor the deputy registered officer – party treasurer and Hanson’s brother-in-law Greg Smith – informed the electoral commission of the changes in legal structure of the entity. There were two reporting deadlines missed by One Nation – notification of the changes should have been delivered seven days after December 31 and March 31. 

News of One Nation’s constitutional high jinks follows revelations over the past six months related to the party’s preselection and disendorsement processes during the West Australian election, questions about its compliance with goods and services tax legislation, and doubts about the donation and declaration of an aeroplane to Pauline Hanson for campaigning purposes.

It also follows a network-wide ban of the ABC, announced in a Facebook video posted by Hanson after the April 3 airing of a Four Corners report that highlighted a range of issues faced by One Nation. The program, criticised by Hanson and her colleagues as a media “stitch-up”, has resulted in a formal investigation by the Australian Electoral Commission, related to the donation of the two-seater plane.

Pauline Hanson’s One Nation is the business name of One Nation Queensland Division Incorporated, which was an unincorporated association since it registered on January 23, 2001. That changed last year when the entity was incorporated with the same ABN. 

The entity is regarded as the same for tax purposes and the name of the unincorporated body has transitioned into the incorporated form……

And that’s where the law comes in. The facts as we know them are that Ashby has a plane, in which he flies Hanson around the country on what is clearly One Nation business. Hanson herself has made numerous public statements, including on the party website, asserting that the plane belongs to One Nation. It is literally plastered with her name and face.

One Nation is a registered political party. The Commonwealth Electoral Act requires each party, and each of its state branches, to lodge an annual return with the Australian Electoral Commission, within 16 weeks after the end of each financial year. The annual return must include disclosure of all amounts received by, or on behalf of, the party from any single source totalling more than $13,000 (for the 2015-2016 year).

Donations are expressly defined as including the value of a gift. There is no room for doubt that, if a generous supporter gave an aeroplane to an official of the party, so that that official could fly the leader of the party around the countryside on party business, then the gift of the plane (or the cash to buy the plane, if that’s what happened) would be required to be disclosed in the party’s next annual return to the AEC.

Queensland has its own political donation disclosure laws, which are tougher than the federal regime. Returns are required to be lodged six-monthly, all gifts over $1000 must be disclosed, and any gift worth more than $100,000 has to be reported within seven business days.

One Nation’s Queensland Electoral Commission return for the relevant period in 2016 discloses nothing about the aircraft purchase or gift, but it does include an expenditure item of $1187.09 paid by the party to “Jabiru Aircraft Service”. There are numerous payments to Ashby’s companies for printing services, totalling some $17,000 in the same period. Who was paying for the running costs of the aircraft is a mystery.

But it’s pretty simple, really. Whoever paid for Hanson’s plane — however they paid for it and who legally or beneficially owns it — it was, in form and substance, a gift to the direct benefit of her eponymous political party, and she has treated it and talked about it as exactly that for the past two years…..

One Nation’s Senator Hanson shifted her story again on Monday night and said a $106,000 plane “came from” party donor Vicland’s Bill McNee to be used by her chief of staff James Ashby, but it was not a donation.

“So the plane came from Bill McNee, but it was not for the party it was to James for his business?” Sky News’ Andrew Bolt asked.

“Correct,” she answered……

Last night Senator Hanson said the Victorian businessman had allowed Mr Ashby to use the plane.

“He didn’t donate the plane to James Ashby. Having met James, they became friends,” Senator Hanson told Sky News.

“Bill’s a developer and he actually has a lot of business that he does in Queensland, and Bill was continually looking around for a plane.

“He found out James was a pilot (and) he thought: “Here’s a great opportunity to actually have a plane and to actually ¬use it as well.’ ”

Pauline Hanson’s controversial chief of staff says he has a “crossover” business relationship with the Melbourne property developer and political donor at the centre of a disclosure row over the purchase of the light plane used by the One Nation leader for election campaigning.

But James Ashby, whose iron-fisted control of Senator Hanson’s office has created ructions inside the party, insisted yesterday that he bought the $106,000 Jabiru 23-D aircraft in 2015 for recreational use and for his printing business in Queensland.

Senator Hanson raised further questions about the status of the plane on Monday when she confirmed on Sky News it had “come from” Bill McNee, but was for Mr Ashby’s firm, not her travel for One Nation.

This conflicts with the media-shy businessman’s assertion that he had no knowledge of the aircraft or how Mr Ashby acquired it. Mr McNee’s company, Vicland, is the Hanson party’s biggest donor, though in a rare interview last November he told The Australian he was stopping all political donations because “it’s something I don’t believe in any longer”.

Pressed on whether he had provided funds to Mr Ashby to buy the plane two years ago, Mr McNee said: “My God, if I am going to buy a plane, I would buy one for myself.” He hung up when contacted yesterday.

The Australian Electoral Commission is investigating whether the acquisition of the plane by Mr Ashby and its use to fly Senator Hanson to campaign events in Queensland before her re-election to federal parliament last July subverted financial disclosure laws.

The fiery redhead, renowned for her garish wardrobe, had pleaded not guilty to fraudulently registering One Nation in the state of Queensland. She also denied dishonestly obtaining A$500,000 (£206,000) in electoral funds used for the campaigns of 11 politicians elected to the Queensland state parliament….

Prosecutors had accused Hanson and Ettridge of passing off a list of 500 supporters as genuine, paid-up members of One Nation in order to register the party and apply for electoral funding.

The Sydney Morning Herald, 20 August 2003:

Former One Nation leader Pauline Hanson and party co-founder David Ettridge have been jailed for three years each after being found guilty of fraud charges by a Brisbane District Court jury.

Judge Patsy Wolfe made no recommendation for parole.

           

Hanson, 49, and Ettridge, 58, had pleaded not guilty to fraudulently registering One Nation in Queensland on December 4, 1997.

Hanson had also pleaded not guilty to dishonestly obtaining almost $500,000 in electoral reimbursements after the 1998 state election.

But a Brisbane District Court jury found the pair guilty on all counts after more than nine hours of deliberations.

MARK COLVIN: But first, the freeing of Pauline Hanson and David Ettridge. The One Nation co-founders have won their bid to get out of jail, after successfully overturning their convictions and their three-year sentences for electoral fraud.

Eleven weeks ago, Hanson and Ettridge were both sentenced to three years jail, after a jury found that they'd fraudulently registered the One Nation Party which they'd founded. Hanson was also found guilty of fraudulently obtaining nearly half a million dollars in electoral funding.

But they'll soon be released from jail, and family and friends were elated by the decision when it came down at Queensland's Court of Appeal this evening.

A Russian government think tank controlled by Vladimir Putin developed a plan to swing the 2016 U.S. presidential election to Donald Trump

(Reuters) - A Russian government think tank controlled by Vladimir Putin developed a plan to swing the 2016 U.S. presidential election to Donald Trump and undermine voters’ faith in the American electoral system, three current and four former U.S. officials told Reuters.

They described two confidential documents from the think tank as providing the framework and rationale for what U.S. intelligence agencies have concluded was an intensive effort by Russia to interfere with the Nov. 8 election. U.S. intelligence officials acquired the documents, which were prepared by the Moscow-based Russian Institute for Strategic Studies [en.riss.ru/], after the election.

The institute is run by retired senior Russian foreign intelligence officials appointed by Putin’s office.

The first Russian institute document was a strategy paper written last June that circulated at the highest levels of the Russian government but was not addressed to any specific individuals.

It recommended the Kremlin launch a propaganda campaign on social media and Russian state-backed global news outlets to encourage U.S. voters to elect a president who would take a softer line toward Russia than the administration of then-President Barack Obama, the seven officials said.

A second institute document, drafted in October and distributed in the same way, warned that Democratic presidential candidate Hillary Clinton was likely to win the election. For that reason, it argued, it was better for Russia to end its pro-Trump propaganda and instead intensify its messaging about voter fraud to undermine the U.S. electoral system’s legitimacy and damage Clinton’s reputation in an effort to undermine her presidency, the seven officials said.

The current and former U.S. officials spoke on the condition of anonymity due to the Russian documents’ classified status. They declined to discuss how the United States obtained them. U.S. intelligence agencies also declined to comment on them.

Putin has denied interfering in the U.S. election. Putin’s spokesman and the Russian institute did not respond to requests for comment.

The documents were central to the Obama administration's conclusion that Russia mounted a “fake news” campaign and launched cyber attacks against Democratic Party groups and Clinton's campaign, the current and former officials said.

“Putin had the objective in mind all along, and he asked the institute to draw him a road map,” said one of the sources, a former senior U.S. intelligence official.

Trump has said Russia’s activities had no impact on the outcome of the race. Ongoing congressional and FBI investigations into Russian interference have so far produced no public evidence that Trump associates colluded with the Russian effort to change the outcome of the election.

Four of the officials said the approach outlined in the June strategy paper was a broadening of an effort the Putin administration launched in March 2016. That month the Kremlin instructed state-backed media outlets, including international platforms Russia Today and Sputnik news agency, to start producing positive reports on Trump’s quest for the U.S. presidency, the officials said.

Russia Today did not respond to a request for comment. A spokesperson for Sputnik dismissed the assertions by the U.S. officials that it participated in a Kremlin campaign as an “absolute pack of lies.” “And by the way, it's not the first pack of lies we're hearing from 'sources in U.S. official circles'," the spokesperson said in an email.

Cyber Attacks

Neither of the Russian institute documents mentioned the release of hacked Democratic Party emails to interfere with the U.S. election, according to four of the officials. The officials said the hacking was a covert intelligence operation run separately out of the Kremlin.

The overt propaganda and covert hacking efforts reinforced each other, according to the officials. Both Russia Today and Sputnik heavily promoted the release of the hacked Democratic Party emails, which often contained embarrassing details.

The former prime minister used an interview with his friend and media booster, Alan Jones, on Sky News, on Tuesday night, to say he would continue to make public contributions as he saw fit, and Abbott slapped down Malcolm Turnbull for suggesting he was intent, with his incursions, on driving down the Coalition’s performance in the Newspoll.

Sacked former prime minister and current Liberal party backbencher, the Member for Warringah Tony Abbott, is once more suggesting ways for the parasitical rich and right wing extremists to maintain their hold on federal government.

A somewhat nebulous policy outline which could be aptly titled Abbott's Five Point Plan to Make Australia Right Again includes a pick 'n' mix of these actions:

“STOP PANDERING TO CLIMATE CHANGE THEOLOGY”, CUT THE RENEWABLE ENERGY TARGET (RET) AND STOP FUNDING WIND POWER

CUT IMMIGRATION

MAKE IT EASIER FOR FUTURE GENERATIONS TO FIND WORK

REFORM THE SENATE

CELEBRATE AUSTRALIA

Forget about the increasing effects of climate change, racism, unequal distribution of wealth, taxation policies which favour the rich, the investment-driven housing bubble, a decreasing number of adequately funded community services, record low wages growth, fewer full time jobs, current underemployment and unemployment, as well as sustained attacks on the living standards of those on low incomes!

Abbott insists that his agenda will magically reduce our power bills, make housing more affordable, protect our rights, return the federal budget to health, allow government to flourish and win the Liberal-Nationals power again at the 2018-19 general election.

From the perspective of an ordinary Australian not blessed with Anthony John “Tony” Abbott’s privileged upbringing, salary package and superannuation scheme, this agenda looks more like a recipe for political disaster for the Liberal-Nationals coalition rather than one addressing the electorate’s widely-held genuine concerns.

In short, it would be better labelled Five Ways To Lose An Australian General Election.

It has been included in a group of documents that the defendants now have to produce.

Fish v Kobach was still before the court in October 2017 when the American Civil Liberties Union (ACLU)  published this update, Unsealed Documents Show That Kris Kobach Is Dead Set on Suppressing the Right to Vote which contains a link to a Kobach deposition filed on 26 October 2017.

On 3 January 2018 President Donald Trump announced that the Presidential Advisory Commission on Election Integrity had been dissolved allegedly due to a refusal on the part of a number of states to supply the commission with voter registration details rather than an obvious failure to find evidence of voter fraud during the past seven months.

2018 also sees Trump's Muslim Ban still being contested before US courts.

The Turnbull Government may strike a pose each and every day - that won't change the mood in the electorate

Right now the political colour of Australian government is Liberal-Nationals 3 (Federal, NSW, Tas) to Labor 6 (ACT, NT, Qld, SA, Vic, WA).

The Turnbull Government next goes to the polls at a federal general election sometime between 4 August 2018 and 18 May 2019.

Before then Queensland, South Australia and Tasmania face the voters again at state elections.

Between August 2018 and May 2019 News South Wales and Victoria also have elections.

While the Northern Territory doesn’t have to think about a state election again until 2020. [Australian Parliament website, States and territories: next election dates]

The Liberal and Nationals political fight for voters hearts and minds is going to be fierce and is likely to be nasty given they have so few allies at state government level.

This is what they have to overcome to regain the electorates confidence in both tiers of government - their own entitlement culture, a predilection for budgetary cost cutting at the expense of the poor and vulnerable which smacks of class warfare, an ideological straightjacket hampering vital national policies and open hostility to ordinary wage earners.

Sally McManus is the hero of workers. Turnbull is welcome to try to villainise her, but in doing so, he’s only making himself the enemy.

In her first television interview as head representative of people who work, McManus was involved in what media-insiders call a ‘gotcha moment’. Courtesy of the get-me-a-gotcha-moment-in-place-of-any-useful-political-analysis-queen, Leigh Sales. In their version of events, McManus was in hot water for backing the safety of workers at any cost, even if that cost is breaking laws designed to help employers shirk any responsibility for protecting people who work for them.

Right wingers squealed in delight when Sales drew supposably controversial comments out of McManus so early in the piece. The attacks came thick and fast from all the obvious places, including many journalists, who tut-tutted about law-breaking as if the law-breaking in question was home invasion or carjacking. Even those from Fairfax, who were more than happy to illegally strike in protest at their own colleagues being sacked, apparently can’t see the irony of criticising workers who do the same thing when a colleague is killed. Christopher Pyne, jumping on McManus like a seagull on a chip, called on her to resign. Turnbull, grasping for something to divert from his own failures, said he couldn’t work with her.

A year ago, this whole episode would have been yet another predictable, not worth mentioning, union bashing media-beat-up. But things have changed in the past few months. People have woken up to wealth inequality. Australia saw this wake up contribute to Brexit and the election of Trump. Closer to home, we’ve had One Nation pop up in Turnbull’s double dissolution, only to be over-egged and come crashing back down in the WA election, where, lo and behold, Labor achieved an 8% swing in their primary vote without any help from minors.

Throughout this time, Turnbull’s government continues to be a mixture of insipid do-nothing indecision, scandal and destruction, infighting and chaos, ideological bastardy and economic incompetence while they sidestep from one policy disaster to the next. Amongst the attacks to Medicare, the undermining of welfare through the Centrelink debacle, the failure on energy policy, the distractions from fringe fundamentalists such as anti-marriage-equality and repealing hate-speech laws, there is one policy which stands shiny and red as the most detestable, a pimple on a bum of failure: an attack to wages through a cut to penalty rates. This decision was the nail in Turnbull’s coffin. Commentators and Federal Liberals can claim all they like that the electoral result in WA was a result of local issues. But there is absolutely no doubting that a cut to wages saw voters melting off Liberals like sweat from Turnbull’s, and Hanson’s brow.

Let’s get something clear. Wages are the central concern of the electorate. Yes, most of us have other concerns, including climate change, education, healthcare, infrastructure, housing affordability, energy policy, immigration, just to name a few. But first on Maslow’s Hierarchy of political needs for left-wing and right-wing voters alike is an economic indicator which is being felt personally in homes from Broome to Launceston, from Townsville to Bankstown: record low wage growth. To put it bluntly, workers aren’t paid enough for the productive labour they contribute to the economy. There is plenty of money being made. It’s just not reaching those who create it….

PHON and Pauline Hanson attempt a Trump

As West Australians vote on Saturday, keen attention will be on a woman who isn’t a candidate, knows little about local issues, and lives a continent away. She is Pauline Hanson and her week-long campaign on the ground in Western Australia has demonstrated why she has stood for election 10 times since 1998 — six federal polls, two in NSW, two in Queensland — with just one victory. It has been a chronicle of chaos. [News.com.au, 10 March 2017]

A minor political party riddled with conspiracy theorists, climate change deniers and other right-wing ratbags, cursed by bad candidate selection, suspect staffing decisions and erratic leadership, now makes yet another mistake – its leader alienates an entire national media platform by banning ABC journalists from its post-election event in Western Australia.

Apparently failing miserably as a de facto Liberal Party partner at the 11 March 2017 state general election was just not enough for Pauline Hanson and sidekick James Ashby. They decided to take a leaf out of Donald Trump’s crazy political playbook.

Response from the ABC has been restrained but firm.

Statement from ABC Editorial Director: exclusion of ABC journalists by One Nation officials

The ABC is deeply concerned at the decision by One Nation to single out and exclude ABC reporters from its official election night function in Perth on Saturday night.

I have been in communication with One Nation officials since early Sunday seeking an explanation.

Despite the fact that One Nation has claimed that all media were treated appropriately and obtained material from a pool camera on the night, the facts remain that:

*Other media representatives from a range of organisations attended on the night without any prior arrangements or permission being required.

*Those other media representatives, who included broadcasters, agencies and newspaper reporters from inside and outside Western Australia, were granted immediate access to the event.

*The ABC was denied access, and was treated differently to all other media.

Throughout the Western Australian election campaign, the ABC has provided accurate, impartial and independent political coverage and all political parties have been the subject of appropriate scrutiny and questioning.

If the ABC has been denied normal access to political events for simply doing its job, then that is an attack not just on the public broadcaster but on the fundamental role of the media in a democracy.

On 14 March 2017 with 75.92% of Lower House ballot papers counted PHON only had 4.83% of the primary vote with no seat gained and with 67.66% of Upper House ballot papers counted PHON had only 7.95% of the primary vote with one seat gained to date.

Weintraub took office as a Member of the United States Federal Election Commission (FEC) on December 9, 2002.  After an initial recess appointment, her nomination was confirmed by unanimous consent of the United States Senate on March 18, 2003.  Commissioner Weintraub has twice served as Chair of the Commission, for calendar years 2003 and 2013.

During the election contest arising out of the 1996 election of Senator Mary Landrieu (D-LA), Ms. Weintraub served on the legal team that advised the Senate Rules Committee. Her tenure with Perkins Coie represented Ms. Weintraub’s second stint in private practice, having previously practiced as a litigator with the New York law firm of Cahill Gordon & Reindel.

Before joining Perkins Coie, Ms. Weintraub was Counsel to the Committee on Standards of Official Conduct for the U.S. House of Representatives (the House Ethics Committee). Like the Commission, the Committee on Standards is a bipartisan body, evenly divided between Democratic and Republican members. Ms. Weintraub’s work focused on implementing the Ethics Reform Act of 1989 and subsequent changes to the House Code of Official Conduct. She also served as editor in chief of the House Ethics Manual and as a principal contributor to the Senate Ethics Manual. While at the Committee, Ms. Weintraub counseled Members on investigations and often had lead responsibility for the Committee’s public education and compliance initiatives.

Ms. Weintraub received her B.A., cum laude, from Yale College and her J.D. from Harvard Law School. A native New Yorker, she is a member of the New York and District of Columbia bars and the Supreme Court bar.

CoA Institute requests that you open an investigation² to determine whether Ellen Weintraub, a Commissioner of the Federal Election Commission (“FEC”), violated applicable ethics regulations when she used government property and official time to call on President Trump to provide evidence of his claims of voter fraud in New Hampshire and then continued to promote her statement after it was issued. We also urge you to determine whether it is appropriate for the FEC website to continue to host Commissioner Weintraub’s statement.

Voting in federal elections is an obstacle course for U.S. citizens compared with Australian voting rules

Next time you feel inclined to bitch about being obliged to exercise your right to vote in Australian elections, pause and be thankful you still have a relatively unfettered ability to vote.

Because the largest and most well-known Western democracy is bit by bit taking that right away from its own citizens – and given the number of far-right wing ideologues in the current Australian federal parliament and their obvious admiration for the US Republican Party we may yet have to fight to keep them from tampering with our near universal franchise.

Nearly half of counties that previously approved voting changes with the federal government have cut polling places this election.

When Aracely Calderon, a naturalized US citizen from Guatemala, went to vote in downtown Phoenix just before the polls closed in Arizona’s March 22 presidential primary, there were more than 700 people in a line stretching four city blocks. She waited in line for five hours, becoming the last voter in the state to cast a ballot at 12:12 am. “I’m here to exercise my right to vote,” she said shortly before midnight, explaining why she stayed in line. Others left without voting because they didn’t have four or five hours to spare.

The lines were so long because Republican election officials in Phoenix’s Maricopa County, the largest in the state, reduced the number of polling places by 70 percent from 2012 to 2016, from 200 to just 60—one polling place per 21,000 registered voters. Previously, Maricopa County would have needed federal approval to reduce the number of polling sites, because Arizona was one of 16 states where jurisdictions with a long history of discrimination had to submit their voting changes under Section 5 of the Voting Rights Act. This part of the VRA blocked 3,000 discriminatory voting changes from 1965 to 2013. That changed when the Supreme Court gutted the law in the June 2013 Shelby County v. Holder decision.

The polling place reductions in Maricopa County were a glaring example of a disturbing trend. The Leadership Conference for Civil Rights surveyed 381 of the 800 counties previously covered by Section 5 where polling place information was available in 2012 or 2014 and found there are 868 fewer places to cast a ballot in 2016 in these areas. “Out of the 381 counties in our study, 165 of them—43 percent—have reduced voting locations,” says the important new report.

On Saturday, the U.S. Supreme Court restored a Republican-supported law in Arizona banning political campaigners from collecting absentee ballots filled out by voters.

In New Jersey, a federal judge decided against the Democratic National Committee in a complaint it brought against the Republican National Committee, ruling that the RNC’s poll monitoring and ballot security activities did not violate a legal settlement.

But in a ruling hailed by voting rights advocates, a federal judge late Friday ordered county elections boards in North Carolina to immediately restore registrations wrongfully purged from voter rolls.

All of this comes as this year’s presidential election is the first in half a century to take place without the full protection of the Voting Rights Act.

In 2013, the Supreme Court struck down crucial components in Section 5 of the act in a case called Shelby County v. Holder, when it ruled that states with histories of voting-related racial discrimination no longer had to "pre-clear" changes to their voting laws with the federal government.

New Voting Restrictions in Place for 2016 Presidential Election

In 2016, 14 states will have new voting restrictions in place for the first time in a presidential election. The new laws range from strict photo ID requirements to early voting cutbacks to registration restrictions.

Those 14 states are: Alabama, Arizona, Indiana, Kansas, Mississippi, Nebraska, New Hampshire, Ohio, Rhode Island, South Carolina, Tennessee, Texas, Virginia, and Wisconsin.

(This number decreased from 15 to 14 when the D.C. Circuit blocked a voter registration requirement in Alabama, Georgia, and Kansas on September 9, 2016. Georgia was removed, but Alabama and Kansas remain on the map because certain restrictions remain in place. Other recent court rulings have impacted the map: North Carolina and North Dakota were removed after courts blocked restrictive laws. Despite a recent court victory mitigating the impact of Texas’s photo ID law, it is still included because the requirement is more restrictive than what was in place for the 2012 presidential election.)  

This is part of a broader movement to curtail voting rights, which began after the 2010 election, when state lawmakers nationwide started introducing hundreds of harsh measures making it harder to vote.

Overall, 20 states have new restrictions in effect since the 2010 midterm election. Since 2010, a total of 10 states have more restrictive voter ID laws in place (and six states have strict photo ID requirements) seven have laws making it harder for citizens to register, six cut back on early voting days and hours, and three made it harder to restore voting rights for people with past criminal convictions.

More than 18,000 people have been asked to explain why they apparently voted more than once at the federal election.

Despite heavy fines and the risk of jail time for multiple voting, two people were marked off the electoral roll 11 times on July 2. 

A further two people had their names marked off five times, while four others had four marks and 51 people had three marks.

Australian Electoral Commissioner Tom Rogers told a Senate estimates hearing on Tuesday night 18,343 people have been asked to explain why their name was checked off more than once, with many expected to be in error.

The Commonwealth Electoral Act allows for fines of $10,800 or up to a year in jail for people convicted of multiple votes. Anyone found to have impersonated someone else at the ballot box faces up to six months in jail or a fine of $1800.

Before this year's election the AEC wrote to more than 4600 people with a prior history of apparent multiple voting to remind them of the law.

Mr Rogers said individuals who had two or more marks next to their name at the past two elections were sent warning letters.

"We wrote to a select group of people we thought may be at risk of not understanding their obligations under the Electoral Act," he said.

"We've never done that before.

"That was an attempt to demonstrate the seriousness with which we treat this particular issue." 

AEC officials will assess how many recipients of the letters are among those recorded as having their name marked off more than once. 

Liberal Party dirty linen spills out of the cupboard yet again

The Liberal Party has suspended a campaign director in the 2015 NSW election, after he was charged with electoral crimes in a marginal seat where the Australian Labor Party candidate was anonymously smeared as a paedophile.

The NSW Electoral Commission has taken action under the Parliamentary Electorates and Elections Act against Jim Daniel, who ran the campaign for the seat of East Hills, which MP Glenn Brookes unexpectedly retained by just 628 votes, or 0.8 per cent, in 2015.

During the campaign about 300 posters of ALP candidate Cameron Murphy, a human rights lawyer who has an Order of Australia and is the son of High Court judge Lionel Murphy, were defaced with stickers saying "paedophile lover," "stranger danger" and "our children are not safe".

In 2015 ALP MP Lynda Voltz, under parliamentary privilege, accused Mr Daniel, who is on Bankstown City Council, of organising the defacement of the posters.

At that time Mr Daniel said the accusations were "just another attempt to reheat issues previously raised and dealt with".

The Electoral Commission issued a statement on Friday that it had investigated a number of complaints and served two notices on Mr Daniel to appear at Downing Street Court.  

"It will be alleged by the NSWEC that political campaign material distributed in the electorate of East Hills was in contravention of the act."

The NSW division of the Liberal Party said on Sunday that Mr Daniel was suspended and the NSWEC was the right body to investigate any complaints.

EAST Hills Liberal MP Glenn Brookes will stand aside from the Liberal Party and will serve on the crossbench until the outcome of a charge against his campaign manager over an alleged breach of the electoral act involving a paedophile slur is determined.

Mr Brookes will also step aside from his parliamentary committee roles, including serving on Premier Mike Baird’s parliamentary ethics committee until the matter is resolved.

The scandal now threatens to produce a possible by-election.

Labor candidate Cameron Murphy, who was the head of the NSW Council for Civil Liberties, lost the seat of East Hills by less than 400 votes — or 0.2 per cent — after the dirty campaign.

In the week before polling day, 300 of Mr Murphy’s posters were defaced with stickers falsely declaring him “a paedophile lover”.

Thousands of anonymous pamphlets were also letterboxed wrongly claiming Mr Murphy, the son of former High Court Judge and Federal Attorney-General Lionel Murphy, had stood up for paedophiles.

The matter is listed for mention at the Downing Centre Local Court on May 3….

THE Liberal Party has endorsed two south ward candidates for Bankstown Council's election in September. Picnic Point resident Jim Daniel and Revesby's Vanessa Gauci will run on the south ward ticket.

Father-of-two Mr Daniel was preselected to run as number one on the ticket.

"I am honoured by the trust that has been shown in me by so many people who sincerely know that I have what it takes to be a successful south ward councillor on Bankstown Council," Mr Daniel said…..

East Hills state Liberal MP Glenn Brookes has stepped down from his role on Bankstown Council after eight years.

Mr Brookes stood down from the council at last month's local government elections under new state government laws prohibiting anybody from holding a council and an MP position at the same time. "During my eight years on council more than $288 million has been spent on capital works and I am pleased to say that $26 million has been spent in my South ward," he said. Mr Brookes' heir in South ward is newly minted Liberal councillor Jim Daniel.

The Bankstown Liberal councillor accused in Parliament of being involved in an election smear campaign has called the accusations "cowardly".

Jim Daniel denies being involved in a smear campaign that wrongly implied East Hills Labor candidate Cameron Murphy was a "paedophile lover".

Mr Daniel, who was the campaign manager for East Hills state Liberal MP Glenn Brookes during the State Election, was named by Labor MP Lynda Voltz in Parliament on Thursday.

Using parliamentary privilege, Ms Voltz said a resident saw Mr Daniel delivering the unauthorised leaflets during the campaign. In one leaflet it states "if a convicted child rapist lived next to you would you want to know?" alongside a photo of Mr Murphy.

East Hills was the tightest seat going into the election.

Despite Mr Murphy being favourite to win the seat back for Labor, Mr Brookes won by 372 votes with a slight swing in his favour.

In Parliament last Thursday, Ms Voltz said copies of the pamphlets were delivered to Padstow, Georges Hall, Revesby and Panania…..

Mr Daniel, a Bankstown councillor, has denied any involvement. "I've had enough of them trying to belittle me. It's a hard enough job in politics without people crying over spilt milk," Mr Brookes said.

"They can't get over that I won. I told the people from (Liberal Party) hierarchy 'don't write me off'." East Hills had always been a Labor seat until Mr Brookes won in 2011 and he was re-elected in March despite only holding the seat by 0.2 per cent.

"They think they have a God-given right to the (East Hills) area - nobody does," he said.

Mr Brookes challenged Labor to accuse him of involvement in the smear campaign outside parliament. "Have a cheque book ready and have a go," he said.

Canterbury Bankstown Express, 6 May 2014:

Bankstown councillor Jim Daniel says he is "disappointed" he has been forced to defend himself over a business networking event he helped organise in 2012 that has been referred to ICAC due to a connection to former energy minister Chris Hartcher.

Cr Daniel helped his friend, accountant George Germanos, organise the networking meeting for Mr Germanos's Georges River Club at Bankstown Paceway in July 2012.

Mr Hartcher, who is being investigated by ICAC over allegations of a slush fund, was the guest speaker.

Cr Daniel said he asked East Hills state Liberal MP Glenn Brookes, for whom he works as an electorate officer, to invite fellow government members to attend.

"(Mr Brookes) invited a number of prominent people to attend, and it's just our luck that the one MP who did is now being investigated by ICAC," he said.

Cr Daniel said he and Mr Germanos had written to ICAC and the Electoral Funding Commission before the original event in 2012 to make sure there were no irregularities.

Cr Daniel said it was a shame Mr Brookes was now forced to defend himself for "helping out a staffer". He said there had not been enough money raised from the event to continue holding them.
